ACLU, DC Settles Wrongful Death Lawsuit

The American Civil Liberties Union says it has helped reach a settlement in a wrongful death lawsuit it filed on behalf of the mother of a quadriplegic man who died while custody of the D.C. jail.

The ACLU says 27-year-old Jonathan Magbie died in 2004 after jail officials and Greater Southeast Community Hospital didn't provide adequate medical attention while he served a 10-day sentence for marijuana possession.

ACLU officials say Magbie, who needed a ventilator to breathe, developed pneumonia while incarcerated. He died after being transferred to the hospital.

Fresno County Issues Medical Marijuana I.D. Cards

Dana Bobbitt suffers from Arthritis in the spine and Hepatitis C, he's been a medicinal marijuana patient for four years, but Tuesday was the first day Fresno County recognized his need for the drug.

"It's just a relief that we finally have in our county the documentation to prove we're legitimate patients," said Bobbitt.

Fresno County kicked off its "Medical Marijuana I.D. Card Program" on Tuesday, accepting applications and issuing cards to qualified patients.

Before now, people like Dana had to travel to other counties to legally get the drug, and even then they weren't allowed to bring it back to Fresno County.

State Medical Cannabis Laws are Final!

The U.S. Supreme Court refused to review a landmark decision yesterday in which California state courts found that its medical cannabis law is not preempted by federal law. The Supreme Court's decision in Garden Grove v. Superior Court means that federal law does not prevent state and local governments from implementing medical cannabis laws adopted by voters or state legislatures. In short: federal law does not override state law on medical cannabis!

Protesters Demonstrate Against Man's Drug Arrest

County prosecutors say Orlando Gibson was caught in a drug deal. The 14 protesters who staged a demonstration outside a York district justice's office this afternoon say he's an innocent man, set up in retaliation for speaking out against the police.

Regardless of who's right, the legal system will determine his guilt or innocence another day. After a preliminary hearing today, York County District Justice Richard Martin ruled that there's enough evidence to proceed with a trial.

The protesters -- whose homes included Brooklyn, Philadelphia and Toronto -- vowed to return.

Almost since election day, retiring Rep. Jim Ramstad’s name has been rumored to be in the mix for Drug Czar (more formally known as the head of the White House Office of National Drug Control Policy).

Despite Vote, Medical Marijuana Not Coming To Ferndale Any Time Soon

Even though Carl Swanson won approval from city voters to dispense medical marijuana -- and state voters decriminalized the drug for registered patients last month -- he still won't be open for business anytime soon.

The new state medical marijuana law is in conflict with the ordinance city voters passed for Swanson's National Organization for Positive Medicine, said City Attorney Dan Christ.

"My opinion is that it is preempted by the state ( law )," Christ said.

Christ recently issued a legal opinion for city police and officials on the issue.

Mayor's Marijuana Work Still An Issue For Media

Mayor elect Brian Taylor said he's aware and sensitive to the fact that many residents are opposed to his marijuana advocacy and promised to keep his two lives separate.

"I've made some concessions in terms of my civil rights," he said, in an interview. "But I'm not going to give up my right to campaign against marijuana prohibition."

He said he would keep that campaign separate from his work as mayor, noting that many people are opposed to his views - some so strongly that he's been subject to prank phone calls.

Langley City's anti-hemp bylaw isn't as cut and dried as it used to be.

Langley City's bylaw restricting the sale of hemp products could soon go up in smoke.

City council has asked it staff to review the bylaw, in light of an autumn spat between the municipality and Hempyz, a small downtown store that sold a few health and beauty products containing hemp, along with gifts and novelty items emblazoned with pot leaves.

Supreme Court Refuses to Hear Case on Seized Medical Marijuana

More than three years after Garden Grove police seized a small amount of marijuana from a chronic pain patient, the U.S. Supreme Court on Monday refused to consider the city's argument - which divided California's major law enforcement organizations - that it should not have to give the drugs back.

Advocates cheered the development as a step forward for medical marijuana users to get their "medicine" back from police.

"This is our biggest legal victory to date, and we're very glad it's now become final," said Joe Elford, an attorney with Americans for Safe Access, an Oakland-based medical marijuana advocacy group.
